Donation Terms
Donating to Open Planet
Thank you for considering making a financial donation to Open Planet Community Interest Company (“OP”). Your donation will help OP to fulfil its aims of documenting the major environmental challenges facing our world and accelerating action on the planetary crisis. These Terms & Conditions govern the relationship between OP and you regarding your donation and constitute a legally binding agreement, entered into by each party in consideration of the other’s obligations under these Terms & Conditions.
Nature of donation
By making a donation, you agree and acknowledge that: (i) it is provided to OP as an irrevocable gift, subject to any exercise of you of your right to receive a refund as described below and OP’s right to return any donation at its discretion; (ii) you are aware of and understand the status of OP as a community interest company (more details about that can be found here); (iii) you shall receive no benefit in return for any donation; (iv) OP may use your donation at its discretion but at all times within its stated objectives; and (v) donations to OP are not charitable donations under the law of England & Wales and, as far as OP is aware, you shall not be entitled to any tax relief in respect of your donations nor are any donations eligible for “gift aid” either in the United Kingdom or in any other jurisdiction worldwide.
Conditions
Donations will be accepted from individuals as well as any other legal entities. Donors who are individuals must be aged 18 or over.
Transparency of contributions
OP reserves the right to: (i) request the full name and contact details of any donor; (ii) request from a donor any other information that OP considers to be necessary or desirable to determine the provenance of the donation; and (iii) undertake any further investigations it deems fit to determine the provenance of the donation.
Payment and payment details
You may choose the amount you donate. You must provide us with complete and accurate payment information at the time you agree to make a donation. OP cannot be held liable for any incorrect details that are provided to us. Payment can be made by credit or debit card.
Administration of contributions
All donations to OP shall be made through the Stripe payment link via https://openplanet.org/. By confirming that you wish to proceed with your donation, you authorise our payment provider to request funds from your credit or debit card provider. All donations will be received by our payment provider and will be held by the provider until they are paid out to an OP bank account. Each donation will be identifiable by a unique payment provider identification number and so each is individually refundable, and will be accounted for separately by OP.
From the moment the donation is processed, OP will be legally and beneficially entitled to the full amount of the donation and you shall have no entitlement to the return of a donation in any circumstances other than as specified in these Terms & Conditions.
Refunds and cancellation
You shall be entitled to receive a refund of your donation for up to 14 days after receipt of payment by notifying OP by email at enquiries@openplanet.org. Any requests for a refund of a donation received by OP following expiry of the 14-day period will be ineligible. Any cancelled donations shall be repaid into the account from which the donation was made. Recurring contributions can be cancelled at any time by emailing enquiries@openplanet.org.
Refusal of donations
OP reserves the right to refuse and return any donation in its absolute discretion, including without limitation where a donor refuses to provide any information requested by OP under Clause 3 or where it believes that accepting the donation would conflict with the mission, values or interests of OP and/or where, having regard to the source of the donation, OP considers that to accept the donation could damage the independence or reputation of OP. Any refused and/or returned donations shall be repaid into the account from which the donation was made.
Confidentiality and publicity
You agree not to publicise your donation, except with the prior written consent of OP and then only if you comply with any relevant policies, procedures or requirements of OP. This restriction shall not apply to any options for publicising donations that OP may make available to donors from time to time (e.g. social sharing buttons on donation pages).
Data protection and privacy
Information about how we handle your personal data is set out separately in the OP Privacy Policy. Please note that when you submit your payment details, these details will be transferred to OP’s payment services provider. Your payment data will be collected and processed securely by that provider, whose terms and conditions are different from those of OP. Before you make a donation, please make sure that you are aware of our payment service provider’s Privacy Policy to ensure that you are comfortable with how they will process your personal data.
Exclusion of liability
Neither OP nor any affiliated company, person, employee, agent, officer or director shall be liable for any loss suffered by any donor or other person arising out of or in connection with a donation, whether direct or indirect, including loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, loss of data, and whether caused by tort (including negligence), breach of contract or otherwise, except in respect of any liability for death or personal injury or any other liability which cannot be excluded or limited under applicable law.
Miscellaneous
A failure of OP to assert a right or provision under these Terms & Conditions shall not constitute a waiver of that right or provision. If any provision of these Terms & Conditions is held by a court of competent jurisdiction to be invalid, illegal or unenforceable for any reason, that provision shall be eliminated or limited to the minimum extent such that the remaining provisions of these Terms & Conditions will continue in full force and effect. These Terms & Conditions constitute the entire agreement between you and OP in respect of any donations made by you and are not intended to confer any contractual benefit on any person pursuant to the terms of the Contracts (Rights of Third Parties) Act 1999. These Terms & Conditions and any non-contractual obligations arising out of or in connection with them will be governed by English law and subject to the exclusive jurisdiction of the courts of England and Wales.
